The Commission lays down a set of guidelines and principles for online platforms in order to step up the fight against illegal content online.
With the aim of improving the implementation of practices for the prevention, detection, removal and disabling of access to illegal content, it also clarifies platform liability when proactive steps are taken („Good Samaritan” actions).
The guidance covers all categories of illegal content while ackowledging that different types of content may require different treatment.
It relates to the activities of online platforms in the sense of Article 14 of the e-commerce directive.
On detecting and notifying illegal content, the Communication sets out what online platforms, competent authorities, (courts, law enforcement) and users should do in order to detect illegal content quickly and efficiently.
This includes allowing guidance notices by trusted flaggers and users, ensuring the quality of notices, taking proactive measures by online platforms and using automatic detection and filtering technologies.
In particular, the Commission supports further research and innovative approaches to improve the accuracy of technical means to identify illegal content, stating that online platforms should do their utmost to proactively detect, identify and remove illegal content.
On the removal of illegal content, the Communication provides guidelines on ensuring expeditious removal and reporting to law enforcement authorities, enhancing transparency (both on content policy as well as notice-and-action procedures) and safeguards against over-removal and abuse of the system (contesting a notice and measures against bad-faith notices and counter-notices).
On preventing the re-appearance of illegal content, it provides guidelines on measures for repeat infringers and automatic re-upload filters.
In conclusion, the Commission notes that the Digital Single Market requires greater coherence of public policy responses and this Communication is a first step in providing common tools to address the shared challenge of illegal content removal.
